Minimum Qualifications
Requires five years of duties at a level of responsibility that would prepare an individualto perform the position's functions. The work experience must include lead work orsupervisor responsibilities within a large administrative support function. College-levelcourse work in business administration, accounting, finance, or other field directly related to the work to beperformed and specified by the agency, may be substituted for the required workexperience on a year-for-year basis.
Preference will be given for those with American Association of Petroleum Landman coursework or International Right of Way Association coursework in real estate principle, land titles or property descriptions.Knowledge of practices, principles standards and guidelines as it relates to real estate titles and contracts is preferred. Also, additional consideration will be given for familiarity or working knowledge of the North Dakota Century Code pertinent to real property; titles; highways and eminent domain. A learning and understanding of the NDDOT Right of Way manual will be required.
Requiresability to lift up to 20 pounds.

Summary of Work
Prepare acquisition documents and process parcel payment requests: Review all appraisal and negotiation activities to ensure all necessary documentation has been obtained and appraisal/negotiation costs are accurately detailed, math extensions and division of interests correct, in order to process claim for payment and complete project records. Review all legal documents for completion, proper format and recording of permanent documents with respective counties to ensure NDDOT's acquired interest. Accurately prepare claim for payment according to guidelines established by FHWA, financial management, planning and programming, farmers home administration, farm credit, North Dakota guaranty & title and appraisal/negotiation documents. Research for appropriate project number, cost center, object, sub and phase for processing. Enter data in Access program from information contained in file. Properly code for FHWA reimbursement, input by financial management and data retrieval. Record checks on Access program and prepare and sign transmittal letters. Monitor parcel file until closeout of parcel is acceptable. Keep current with IRS guidelines for completion and submission of W 9s of all property owners, fee attorneys, appraisers, interest income and other additional payments considered taxable income for financial management division to report yearly to IRS. Maintain Access program of all W 9s. Compile data and check for accuracy and submit electronically to information technology division for incorporation and completion of 1099s. Communicate with property owner when breakdown of payment or W 9 are not received. Approximately 65 percent of the time will be spent on this duty.
Reimburse right of way expenditures based on FHWA guidelines: Maintain in-depth knowledge of guidelines established by FHWA and financial management for reimbursement of right of way expenditures. Complete proper audit by state and FHWA auditors. Prepare final right of way certificate for all federally participating projects at completion of construction as required by and ultimately submitted to federal highway administration. Audit project and parcel payments to verify expenditures and amounts to final right of way certificate. Total project cost runs to verify expenditures with financial management and accurately resolve if incorrect. Prepare cost summary for right of way certificate, indicating all individual expenditure amounts. Maintain strong Access knowledge to create program and reports and correct errors. Approximately 10 percent of the time will be spent on this duty.
Accurately maintain section reports/project records/forms/mainframe and computer programs. Assist with various cost study reporting, special assignments and to ensure credibility of records: Research and provide information for project studies, requests from other state DOT agencies, legislature or legislative committees. Research and accurately compile annual reports to FHWA on right of way and secondary highway parcels, projects and cost involvement. Research, compile and prepare responses for all right of way activities regarding records management, forms, computers, software. Maintain list of current authorized projects in order for projects to be properly charged. Review all right of way forms for changes. Maintain strong database, word processing and mainframe knowledge to create programs and reports, correct errors, review and assist section on software, application, equipment and mainframe data file problems and increase work efficiency. Maintain thorough knowledge of equipment, applications, operations and computer applications such as Word, Access and mainframe applications. Maintain thorough knowledge of right of way work flow to eliminate duplication of applications (example: convert MicroStation plat text to Word to generate other documents and Access programs. Maintain in-depth knowledge of appraisal/negotiation functions responsible for Access program to recommend changes. Maintain responsibility for county secondary roads Access program to ensure proper data entered and produce accurate reports. Approximately 15 percent of the time will be spent on this duty.
Eminent domain processing: Fully understand and accurately create documents, make deposits to county clerk of court and notify all persons having legal interest in property regarding condemnation. Research parcel files for mortgage companies, clerk of courts and all persons have legal interest in property regarding condemnation. Accurately assemble documents in proper order with proper exhibits and instructions for mailing to all parties. Ensure proper individuals have been contacted and proper documents filed. Maintain record of condemned parcels and status of each, appeal dates if applicable, track case settlement, update reports and manage complete legal file. Represent Department for court testimony regarding proper filing and serving of condemnation documents. Approximately 5 percent of the time will be spent on this duty.
Process legal descriptions for acquisition documents, recording of plats, supplements and permanent right of way documents: Maintain record of exact property owners and if changes/errors are found resolve discrepancies to ensure correct ownership on plat for recording with county recorder. Assist in preliminary acquisition processes by reviewing plats, selecting and preparing appropriate legal documents with owner information and property descriptions. Prepare correspondence to county recorder's office for recording of right of way permanent documents. Prepare correspondence to county auditors, county recorders, ASCS offices and the district offices for the recording of plats and supplements. Maintain files until all recorded documents have been received. Approximately 5 percent of the time will be spent on this duty.
